
WHICH CHARGES CAN I RECOVER?
You can recover all unarranged borrowing fees applied to your bank or
building society account. It does not matter whether your account has already
been closed or whether the account is a business account.
Any fee which is applied by the bank to your account where you are said
to have breached the banks terms and conditions, are recoverable.
The bank charge the fee because they state you breached the terms and conditions
of your account by having insufficient funds in your account when writing
a cheque. This is a penalty imposed upon you by the bank and is recoverable
by arguing it is a penalty.
These unarranged recoverable charges are listed below:-
1. Charges for exceeding an overdraft limit
2. Charges for unpaid standing orders
3. Charges for unpaid direct debits
4. Charges for returned cheques
5. Charges for paid direct debits or standing orders where the account
has insufficient funds
In relation to credit card charges, the credit card companies may charge
no more than £12 for late card payments and exceeding credit card
limits.
Any charges paid above this rate are recoverable. For example a charge of
£30 for a credit limit is recoverable to the value of £18.
The credit card company can charge £12 therefore any charge above
that level can be removed, in this case £18 plus interest.
